Supreme Court Asks AP High Court To Monitor Probe Into Death Of Girl After Anti-Malaria Drive

The Court transfers the proceedings to the Andhra Pradesh High Court for priority monitoring of the investigation.

Taking suo motu cognisance of the reported death of a seven-year-old girl and the illness of several residents of Gollaguppa village in Polavaram District, Andhra Pradesh, allegedly after administration of chloroquine tablets during an anti-malaria drive, the Supreme Court asked the Andhra Pradesh High Court to monitor the investigation.

A bench comprising Chief Justice of India Surya Kant, Justice Joymalya Bagchi and Justice V. Mohana took cognizance based on a letter dated September 2, 2026 addressed to the CJI by one Nallapu Manideep.

The letter referred to a news report stating that around 52 villagers fell ill and were hospitalised after being administered anti-malaria tablets. It also stated that a seven-year-old girl died and 23 other children were shifted to Telangana for medical treatment.

“Keeping in view the seriousness of the issue and the averments to the effect that administration of chloroquine tablets during an anti-malaria drive may have allegedly led to the unfortunate death of the girl child and hospitalisation of several others, we have taken suo motu notice of the concerns raised in the letter.”, the Court said.

Appearing for the State of Andhra Pradesh, Senior Advocate Sidharth Luthra informed the Court that the authorities had already taken cognizance of the incident and that a criminal case had been registered. He further submitted that the viscera report was still awaited.

However, the Court was of the view that the matter warranted judicial oversight until the investigation reached its logical conclusion.

“It seems to us that the matter warrants judicial oversight until the ongoing investigation is taken to its logical conclusion.”, the Court said, adding that the Andhra Pradesh High Court would be the appropriate forum to monitor the investigation and any consequential proceedings.

“We are, however, of the view that High Court of Andhra Pradesh would be the appropriate forum to monitor the investigation and any consequential proceedings.”, the Court said, while transferring the proceedings to the Andhra Pradesh High Court and requested its Chief Justice to take up the matter on a priority basis.

The writ petition was consequently disposed of.
