Delhi High Court Orders Police Protection For Woman Lawyer Facing Family Pressure To Marry Against Her Will

The Delhi High Court has directed the police to provide protection to a 26-year-old woman advocate who alleged that she was facing threats, coercion and interference from her parents and relatives over her refusal to marry a person chosen by them.

Justice Saurabh Banerjee passed the order while dealing with a plea filed by the woman seeking protection of her life, personal liberty and dignity.

The woman, who is enrolled with the Bar Council of Delhi, claimed that her parents and relatives were allegedly threatening and coercing her and attempting to forcibly take her to her parental home and compel her to reside there against her wishes.

She further alleged that she was being pressured to marry a person of their choice against her will.

According to the plea, she had consequently decided to reside separately in Uttam Nagar, but the alleged threats and coercion continued.

While issuing notice on the plea, the Court noted that the petitionedman was a grown-up adult allegedly being subjected to force in matters concerning her purely personal choices.

“Keeping in view the facts and circumstances involved, especially to protect the fundamental right to life and liberty of the petitioner, who, though being a grown up adult is allegedly being subjected to force in matters purely of her personal choice, she shall be free to get in touch with the SHO…,” the Court ordered.

The Court directed the SHO and concerned Head/Beat Constables to take all possible steps to provide adequate assistance and protection to the woman, as and when required, in accordance with law.

It further clarified that if the woman chooses to reside within the jurisdiction of another police station, she must inform the concerned SHO of the change and provide complete details, including her address, within three days of shifting.

The concerned SHO has been directed to take all possible steps to provide her assistance and protection whenever required.
