Asaram Bapu's interim bail to meet ailing wife rejected, High Court allows video call

Asaram Bapu was denied interim bail by the Gujarat High Court, which allowed him to seek permission to speak to his wife via video conference after doctors said her health condition was stable.

The Gujarat High Court on Wednesday rejected an interim bail plea of self-styled godman and rape convict Asaram Bapu, who had sought 20 days of temporary release on humanitarian grounds to meet his 83-year-old wife, who is undergoing treatment at a hospital. However, the court allowed him to seek permission to speak to her through video conferencing.

A division bench of Justices Geeta Gopi and LS Peerzada rejected the plea after reviewing a police report on the health condition of Asaram's wife. The court had on Tuesday directed the police to verify her condition and submit a report, which was subsequently filed along with statements from the two doctors treating her.

Appearing for Asaram, his lawyers submitted that he is 86 years old and his wife is 83, and that he was concerned about her health. Citing her condition, they sought 20 days of interim bail to enable him to meet her while she was undergoing treatment.

The government lawyer opposed the plea, referring to the doctors’ statements submitted before the court. The court was informed that Asaram's wife had responded well to treatment and that her condition was currently stable. The doctors also said she was likely to be discharged from the hospital within two to three days.

The government further argued that Asaram's wife was being treated at a multi-speciality hospital and was under the care of her relatives and personal doctor. It therefore contended that there was no need to grant him interim bail.

After considering the submissions and the medical report, the Gujarat High Court rejected Asaram's interim bail plea. However, it allowed him to seek permission from the jail superintendent to speak to his wife through video conferencing.

Asaram is currently lodged in jail after being convicted in a 2013 rape case and sentenced to life imprisonment. Earlier this month, the Gujarat High Court had rejected another interim bail plea filed by him.
