Delhi High Court Grants JioStar Relief Against Rogue Websites Streaming India-West Indies Cricket Series

The Delhi High Court on Wednesday granted JioStar a temporary injunction against rogue websites illegally streaming its coverage of the ongoing India-West Indies cricket series, allowing it to have newly discovered pirate sites blocked without approaching the court afresh each time.

The court limited this relief to websites carrying content identical to what it has already found infringing.

Justice A.J. Bhambhani allowed the relief in Jiostar's plea.

JioStar's counsel explained why an ordinary injunction doesn't work for live sport. Pirate streaming sites go live only when a match starts and disappear once it ends, so by the time the broadcaster identifies a new site and approaches the court, the match and the underlying value of the injunction are already over.

The series in question began on the 17th of this month, with the next match that day and the tournament running until October 17.

To address this, JioStar sought a "real-time blocking" order modelled on relief the same court has granted in other live sporting event cases, including HBO's earlier orders and a September 15 order in a suit by Dr. Aniruddha Joshi.

The court was willing to grant this mechanism, but drew a line during the hearing that shaped the final order.

The judge indicated it would confine the relief to websites carrying content "identical" to what has been found infringing, consistent with the court's approach in the HBO case and their later clarification, rather than extending it to content that is merely similar.

"If it is identical content, then they can block it," the court said.

"If it is similar content, then we can't do it," it clarified.

The court today granted an order in line with its earlier HBO orders and the September 15 order in the Aniruddha Joshi matter, permitting real-time blocking of websites carrying content identical to that already found infringing, to be enforced by the Delhi-based defendants upon receiving the plaintiff's affidavit and supporting evidence.

The matter will be listed before the Joint Registrar on October 29.
