US Supreme Court allows Trump administration to continue third-country deportations

The apparent 6-3 order temporarily lifts lower court requirements for migrants to get a chance to object before being sent to countries to which they have no ties.

The US Supreme Court on Tuesday allowed President Donald Trump’s administration to continue deporting migrants to countries other than their own for now, while the justices consider the legality of the policy.

The Supreme Court said it will hear arguments in December in the case, which challenges the administration’s practice of sending migrants to third countries with which they have no ties.

Lower courts had ruled that migrants must be given a meaningful opportunity to object before being deported to such countries. The Supreme Court’s decision temporarily puts that ruling on hold.

The order appeared to be split 6-3 among the justices.

Federal attorneys told the court that the lower-court ruling had forced the cancellation of a deportation flight carrying about 70 people to three countries.

The justices had previously allowed the deportation flights to continue temporarily when the case came before them last year.

Under a series of often-secret agreements, the Trump administration has deported about 25,000 people to more than two dozen countries, including Liberia and Guyana. Most of those deported have been sent to Mexico.

The Republican administration has said migrants with final deportation orders are sent to third countries when they cannot be returned to their home countries or when their governments refuse to accept them. This includes some migrants with criminal convictions, federal attorneys said.

According to the administration, the countries receiving the migrants provide assurances that they will not be persecuted or tortured.

Immigrant advocates, however, have argued that some migrants have been imprisoned in countries they had never heard of before arriving and faced serious safety risks. Some were left with little choice but to return to the countries they had fled, their attorneys said.

The attorneys also said many of the migrants had no criminal convictions and had been found to face risks of torture or persecution.

The case comes as the Trump administration pursues a sweeping immigration crackdown and has pledged to deport millions of people living in the United States illegally.
