दिल्ली उच्च न्यायालय ने वकील पर 1 लाख रुपये का जुर्माना लगाया, क्योंकि उन्होंने चलती हुई गाड़ी से वर्चुअल सुनवाई में भाग लिया। न्यायाधीश ओम प्रखर शुक्ला ने कहा कि वर्चुअल सुनवाई की सुविधा को न्यायालय की शालीनता और कार्यप्रणाली को नुकसान नहीं पहुँचाना चाहिए। इस मामले में इलेक्ट्रॉनिक साक्ष्य एवं वीडियो कॉन्फ़्रेंसिंग नियमों का उल्लंघन पाया गया।

The Delhi High Court has imposed a cost of Rs. 1 lakh on a counsel after he appeared in a virtual hearing from a moving car, observing that the convenience offered by virtual hearings cannot come at the cost of court decorum or cause disturbance in the conduct of judicial proceedings.

Justice Om Prakash Shukla observed that when the Court has to deal with more than 70 matters in a day, background noise and movement during the hearing are disruptive and affect the Court's ability to proceed with matters.

“While this Court appreciates the convenience offered by virtual hearings, such convenience cannot come at the cost of the decorum of the Court or cause disturbance in the conduct of judicial proceedings,” the Court said.

Justice Shukla was hearing execution proceedings filed by South Indian Bank Ltd and Union Bank of India Ltd against the National Highways Authority of India (NHAI).

The Court noted that the Electronic Evidence and Video Conferencing Rules, 2025 of the Delhi High Court provide that advocates should endeavour not to join proceedings from vehicles, except in exceptional circumstances and with the permission of the Court.

Justice Shukla observed that the requirement was not merely procedural but was intended to ensure that even when counsel appear virtually, they do so from an environment conducive to the proper functioning of the Court.

“There is no such exceptional circumstances existing in the present matter and the conduct of the Counsel is in violation of the rules,” the Court said.

“In view of the aforesaid, a cost of Rs. 1 lakh is imposed upon learned Counsel for the Decree Holder, payable to Delhi High Court Legal Services Committee within one week from today,” it ordered.

The Court also noted that stamp duty on the arbitral award dated November 13, 2024, which was sought to be enforced, was paid on December 24, 2025.

It observed that the payment was beyond one month from the date of execution of the award and was not in consonance with the High Court's judgment in M/s URC Construction (P) Ltd. v. Airports Authority of India.

Another counsel appearing for the decree holder submitted that the stamp duty along with penalty had already been deposited before the Collector and undertook to place proof of the same on record within one week.

The matter was accordingly listed for further hearing on October 15.
