NEW DELHI: The
Supreme Court on Monday agreed to list for hearing a review plea against its May 16 judgment holding that the Hare Krishna temple and educational complex in Bengaluru belonged to ISKCON Bangalore. The plea was filed by ISKCON Mumbai, which has been involved in a long running legal dispute with the Bengaluru society over control of the property, according to PTI.
A bench comprising Chief Justice Surya Kant and Justice Joymalya Bagchi and Justice V Mohana said the review plea and other interim applications would be listed before a bench a week after October 5.
What is the dispute over the Bengaluru temple? The legal dispute is between ISKCON Bangalore, a society registered in
Karnataka, and ISKCON Mumbai, which is registered under the Societies Registration Act, 1860 and the Bombay Public Trusts Act, 1950.
ISKCON Bangalore has maintained that it has been operating independently and managing the Bengaluru temple for decades. ISKCON Mumbai, on the other hand, has claimed rights over the property and argued that ISKCON Bangalore was only its branch.
ISKCON Bangalore had approached the Supreme Court on June 2, 2011, challenging a May 23, 2011 Karnataka high court judgment. The high court had overturned a 2009 trial court order that had recognised ISKCON Bangalore's legal title and granted it a permanent injunction against ISKCON Mumbai.
What did the Supreme Court rule in May 2025?On May 16, 2025, a bench of Justices Abhay S Oka, since retired, and A G Masih set aside the Karnataka high court order and held that the property belonged to ISKCON Bangalore.
The bench noted that the trial court had found that ISKCON Mumbai had produced no evidence showing its possession of the Schedule 'A' property and that there was no evidence supporting its claim.
ISKCON Mumbai later sought a review of the judgment.
Why did the review plea lead to a split verdict? In November 2025, Justices J K Maheshwari, since retired, and A G Masih, who were part of the bench that had delivered the May 2025 judgment, delivered separate views on ISKCON Mumbai's review plea.
Justice Maheshwari found that ISKCON Mumbai had made out a case for review and allowed its application seeking an open-court hearing. In a two-sentence order, he said, âApplications for listing the review petitions in open court are allowed. Notice be issued to the parties,â as quoted by PTI.
Justice Masih took a different view and rejected the review pleas. He said, âAfter having carefully gone through the review petitions, the judgment under review and the material annexed therewith, I am satisfied there is no error apparent on the face of record or any merit in the review petitions, warranting reconsideration of the judgment impugned. The review petitions are, accordingly, dismissed,â as quoted by PTI.
With the two judges taking different views, the review petitions were placed before the Chief Justice for directions.
The Chief Justice had earlier agreed to consider setting up a fresh bench to hear the review plea. The matter will now be listed for hearing along with the interim pleas after October 5.
