सुप्रीम कोर्ट ने यूपी पुलिस की जाँच पर ‘कवरेज‑अप’ कहा, सीबीआई को संभालने की संभावना
कोर्ट ने यूपी पुलिस पर आलोचना की, क्योंकि उन्होंने मोटरसाइकिल सवार को मौके पर पकड़े जाने के बाद भी FIR में ‘अज्ञात’ लिखा और बाद में हाई कोर्ट के आदेश पर नाम जोड़कर उसे मुक्त कर दिया। न्यायमूर्ति ने इस प्रकार की जाँच को सार्वजनिक विश्वास के लिये हानिकारक बताया और सभी यूपी पुलिस मामलों में सीबीआई को हस्तक्षेप करने या पुलिस को पुनर्संरचना करने की ओर इशारा किया।

The Supreme Court on Wednesday came down heavily on the Uttar Pradesh Police over alleged irregularities in a criminal investigation, with a Bench observing that it might direct the Central Bureau of Investigation (CBI) to take over all investigations in the state.
A Bench of Justices Sanjay Kumar and Sanjeev Sachdeva made the remarks while hearing a petition by a complainant who alleged that the police had conducted a biased investigation after a motorcycle rider was apprehended and handed over to them at the scene of an incident, Bar & Bench reported.
The Bench questioned why the police had registered the FIR against an “unknown” motorcycle rider when the complainant had allegedly caught and handed him over to the police.
“FIR was registered against unknown persons? Why did you write unknown if the person was caught at the spot? Why did you register FIR against an unknown motorcycle rider if he was caught on the spot? How will people trust the police?,” he said.
The Court also took exception to the subsequent handling of the investigation. According to the petitioner, the police initially left the accused unnamed in the FIR, but later included the rider’s name in the chargesheet after the High Court sought a status report, before eventually giving him a clean chit.
The petitioner also alleged that the motorcycle had no number plate when it was seized but was later shown as having a registration number during the investigation.
Taking note of these allegations, the Bench questioned the manner in which the investigation had been conducted and remarked:
“Toeing the line is one thing but bending over backwards. And this kind of cover-up job? Less said the better,” it said.
The Court further questioned whether accused persons could be deliberately left unnamed in FIRs and added that such conduct could undermine public trust in the police.
“In everything you have an agenda. How will people trust you if this is how you proceed with matters? It is better if we ask CBI to step in all UP Police investigations. We might as well disband the UP Police. This nonsense has to stop at some point,” the court said.
The Bench also criticised the affidavit filed by the UP Police, describing it as “completely uninspiring”, and directed the concerned police officer to appear before the Court at the next hearing with a better explanation.
The Court specifically sought an explanation for why the FIR had initially been registered against an unknown motorcycle rider despite the police accepting that he had been apprehended at the spot.
The Bench noted that the police affidavit subsequently identified the rider as Tushar and said the authorities must explain why his name was initially left out of the FIR and later added.
