There've Been So Many Corrupt Judges In Supreme Court Who've Damaged Justice : Dushyant Dave

The rich and the powerful have hijacked the judicial system from us, Dave said.

Senior Advocate Dushyant Dave on Friday alleged that the Supreme Court has had many corrupt judges, causing great damage to justice. He further stated that the judicial system has become skewed in favour of the rich and powerful and has increasingly supported an executive that has become more powerful.

Delivering the 17th KM Bashir Memorial Lecture, titled “Are We Failing the Constitution or Has the Constitution Failed Us?”, Dave said that while the judiciary had “some outstanding judges”, the conduct of other judges had caused “great damage to justice”.

“I can tell you as having been a lawyer for 48 years in judiciary that judiciary has some outstanding judges but there have been so many corrupt judges, that I have lost a count now, in Supreme Court,” Dave said.

“I've lost count and they have really done great damage to justice because justice is basic human requirement,” he added.

Dave alleged that the judicial system had become skewed towards wealthy and powerful litigants. “Justice is skewed by them. The rich and the powerful have hijacked the judicial system from us. Their cases are heard fast,” he said.

He further said that large industrial houses frequently obtained favourable judgments.

“Their cases they succeed always. You open up newspaper, business newspaper and you will find that largest industrial houses every second or third day get some judgment in their favour. It is very surprising how they succeed in all cases. There is never a failure by them but that's what is happening,” he said.

Dave also expressed concern about the judiciary's relationship with the executive. He said the judicial system was increasingly supporting an executive that had become more powerful, and argued that the Supreme Court was not adequately exercising its constitutional role under Article 32 to protect fundamental rights.

He stated that the Supreme Court is not interfering under Article 32 to enforce the fundamental rights. He said that concerns about executive excesses are not be confined to the period of Indira Gandhi's government during the Emergency.

“It is not just that Mrs. Gandhi during emergency was responsible for excesses but it's also what is happening in last 12 years in the country that, you know, things are really going beyond control because the fundamental rights which are so essential and Article 32 which, you know, requires Supreme Court to enforce those rights, Supreme Court is not willing to interfere at all even when it sees that fundamental rights are breached”, Dave said.

Dave also sharply criticised the Supreme Court's approach to the SIR exercise, stating that adult franchise is threatened due to the Supreme Court and the Election Commission.

Dave criticises lack of diversity in judiciary

Dave also referred to the composition of the Supreme Court, criticising former Chief Justice of India DY Chandrachud for the absence of women among the judges appointed to the Supreme Court during his tenure.

“Justice Chandrachud, who otherwise claimed himself to be a great, you know, liberal judge, he appointed seventeen judges to Supreme Court. Not one was a woman,” he said.

He emphasised that greater representation from different sections of society was necessary for the judicial system to understand the social context in which disputes arise.

“Most judges in this country are from higher caste and most of them belong to the legal fraternity. Unless you appoint judges from across cross-section of the society, they will never understand the sensitivity that justice delivery demands. Justice delivery is not just giving a judgment in one form or the other. It is to understand what the problems are in the society and how to find a solution to those problems which is equitable and just, not just legal. It must be equitable and just. For that you need judges who are really able to understand the problems of the society, every section”, Dave said.

Dave further said that neither media nor judiciary is protecting the citizens. “Our voice doesn't count because the two pillars which can protect us, the media and judiciary, both have failed us miserably,” he said.

Criticism of media

Dave's criticism of the media arose in the context of the broader socio-economic problems he had discussed during the lecture. He had referred to unemployment, agricultural distress and inadequate investment by Indian companies. He said these problems were not being adequately communicated to citizens because of the manner in which the media was reporting developments.

“Thanks to media today no good or real information is being, is coming to us. There's a massive campaign of disinformation which is going on in this country,” Dave said.

He said television coverage instead presented a consistently positive picture of India's performance. “All that you see on television is how great our country is. I mean, of course it is in our heart. But is it really so?” he asked.

He then gave the announcement and inauguration of large projects as an example. Dave said that since 2014, Prime Minister Narendra Modi had inaugurated projects involving trillions of rupees. He claimed that not even 20% of such projects had actually been executed.

“But media never talks about it. It's the role of media to expose. It's not for us, you and me, citizens. It's for them to, you know, speak about that,” he said.

Dave then specifically questioned the media's scrutiny of Prime Minister Narendra Modi. He said the media did not ask Modi “an inconvenient question” and linked this to the Prime Minister's absence from conventional press interviews.

“But no media never asks an inconvenient question to Mr. Modi and of course how can they because Mr. Modi never gives an interview, actual interview,” Dave said.

He also said that media organisations had their own interests because of their ownership by wealthy and powerful people. “So they don't want to speak against Mr. Modi and BJP or even against any other political party for their wrongdoing. I have no doubt that even wherever the opposition parties are in power in states, they are also doing wrong things. They're not always on the right path,” Dave said.

He added, “Our Prime Minister has not faced media even once since 2014. Media is controlled essentially in India by rich and powerful people and therefore naturally they have their own skeletons.”
