Mamata Banerjee Urges Supreme Court To Urgently List Plea Against ECI Freeze On Trinamool Symbol

Senior Advocate Kapil Sibal on Monday mentioned before the Supreme Court a plea filed by Trinamool Congress leader Mamata Banerjee challenging the Election Commission of India's (ECI) decision to freeze the All India Trinamool Congress (AITC) name and its reserved 'Flowers & Grass' election symbol amid a dispute between rival factions of the party.

Seeking urgent listing of the matter, Sibal questioned the ECI's decision to freeze the party's identity while its proceedings were underway.

"They issue a notification and in the middle of notification, they freeze the symbol. What is going on? We want urgent listing," Sibal submitted.

Chief Justice of India Surya Kant, who was heading the Bench, responded that the rival side would also have submissions to make.

"Both sides will have something to say. When the matter is listed, then argue. We will try to list," the CJI said.

Banerjee's plea challenges the ECI's September 18 interim order barring both rival factions from using the 'All India Trinamool Congress' name and the 'Flowers & Grass' symbol pending a substantive determination of the dispute under Paragraph 15 of the Election Symbols (Reservation & Allotment) Order, 1968.

The ECI had subsequently allotted alternative names and symbols to the two factions for the upcoming October 6 Assembly bypolls. The faction led by Banerjee was allotted the name 'Mamata All India Trinamool Congress' and the 'Football Player' symbol, while the rival faction led by Ritabratra Banerjee was allotted 'Democratic Trinamool Congress' and the 'Envelope' symbol.

The poll panel said it had taken the interim measure as two rival groups were claiming to be the AITC and there was insufficient time to complete the substantive proceedings under Paragraph 15 before the bypolls.

Banerjee has challenged the ECI's decision before the Supreme Court, seeking restoration of the original party name and symbol. The plea comes amid an internal dispute within the TMC following a rebellion within the party after its defeat in the West Bengal Assembly elections.
