सुप्रीम कोर्ट ने सीईसी ज्ञानेश कुमार को निलंबित करने से इनकार, चुनाव आयोग से स्पष्टीकरण मांगा

अदालती बेंच ने ज्ञानेश कुमार को अस्थायी निलंबन नहीं दिया और दो अन्य आयुक्तों की सहमति के बिना निर्णय लेने के आरोपों पर चुनाव आयोग का जवाब माँगा। आयोग ने कहा कि मसौदा चरण में मिलने वाले सुझाव सामान्य प्रक्रिया के भाग हैं और विशेष पुनरावृत्ति (SIR) शेड्यूल पर unanimity बनी रही। कोर्ट ने इन उत्तरों के आधार पर आगे की कार्रवाई का फैसला करने का इरादा जताया।

Supreme Court Declines to Suspend CEC Gyanesh Kumar, Seeks Election Commission’s Response

The Supreme Court on Monday declined to pass an interim order suspending Chief Election Commissioner Gyanesh Kumar, while seeking the Election Commission of India’s response to allegations that he had taken decisions without consulting the two other election commissioners.

A bench headed by Chief Justice of India Surya Kant issued notice to the poll panel while hearing pleas concerning the Special Intensive Revision (SIR) of electoral rolls. The refusal to grant interim relief did not settle the allegations, on which the court sought a response.

COURT SEEKS ANSWERS ON DECISION-MAKING

One plea challenged the functioning of the Election Commission, alleging that powers vested in a multi-member constitutional body were being exercised without following the collective decision-making process mandated by law.

The bench indicated that it could revisit disputed decisions after examining the commission’s response.

“After notice, if they come and show that ABC decisions were taken without unanimity, we will take those decisions back,” the court said.

The allegations remain contested. The Election Commission has rejected suggestions that internal observations by its members amounted to institutional dissent over final decisions.

ECI SAYS INTERNAL INPUTS PART OF ROUTINE PROCESS

The controversy follows a media report that Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi raised formal objections on at least 14 occasions over 10 months concerning electoral rolls, voter registration and the commission’s technology systems.

Responding to the report, the ECI said operational queries, inputs and suggestions at the draft stage were part of its standard administrative and decision-making process.

The commission specifically maintained that decisions concerning the schedule of the SIR exercise were unanimous.

JUSTICE BHUYAN’S REMARKS DRAW POLITICAL RESPONSE

Separately, remarks by Supreme Court judge Justice Ujjal Bhuyan on disenfranchisement prompted Congress leader Jairam Ramesh to demand Kumar’s resignation.

Speaking at the valedictory ceremony of the 19th NALSAR BRS Moot Court Competition in Hyderabad on Sunday, Justice Bhuyan said any process that stripped millions of citizens of voting rights would be arbitrary.

“If any process results in disenfranchising millions and millions of Indian citizens, making them second-class citizens in their own country in the sense of being citizens without voting rights, such a process is intrinsically arbitrary. No amount of whataboutery can justify it. It strikes at the very heart of the Constitution,” he said.

The remarks were made at a public event, separate from Monday’s court proceedings.

Ramesh subsequently accused Kumar of executing “illegal orders” and called for his immediate resignation. Those were the Congress leader’s allegations.

The Indian Youth Congress also organised a protest march in Delhi on Sunday demanding Kumar’s removal.

Led by its national president, Uday Bhanu Chib, demonstrators sought to march from Raisina Road towards Jantar Mantar amid police deployment and barricading. Chib criticised the police for preventing protesters from reaching the designated protest site.
