Maharashtra Magistrate Sends Contempt Notice To Railway Officer Over Failure To Replace Pest-Infested Sofas In VIP Room

A Maharashtra Magistrate last week sent a letter to the Divisional Railway Manager, Nanded Division, asking him to show cause as to why contempt action should not be taken for non-compliance of an earlier direction to replace sofas in the VIP room at Chhatrapati Sambhaji Nagar, which had bed-bugs as well as to conduct pest control.

For context, the Judicial Magistrate (Railways), Aurangabad had in May issued a letter to the DRM directing pest control in the VIP room of the railway station after two Bombay High Court judges had noticed the same and reported it.

Thereafter, last week, the Judge in his letter to the DRM said that it seemed that the sofas had not been replaced in the VIP room and that several High Court judges sitting at Bombay High Court's bench at Aurangabad and who often travel by train and wait in the VIP room.

The letter states that it is a "very disgusting position" for the judges to sit on these sofas they are instead sitting in their cars rather than the VIP room.

The letter notes that the Railways neither took any "satisfactory action" to the earlier letter nor responded to it, and this act is in "blatant disrespect to the direction of the Judicial Officer, which is contemptuous" which has also caused inconvenience to the High Court Judges.

The Magistrate has thus directed the DRM to "show cause as to why action under Contempt of Court Act" should not be taken and has asked the DRM to remain personally present in the court on September 30.
